    Energy4 Remains A Comparison Website

Publication of the Revised Ofgem Confidence Code 2017 identified that Ofgem set out decision to partially implement the removal of the WoM Requirement, and to consult on consequential Confidence Code wording.

The result of this was that Ofgem no longer requires domestic and Non-Domestic Third Party Intermediaries (TPI) to provide Whole-of-Market prices to domestic and business customers. Please note that Ofgem Third Party Intermediaries (TPI) Programme, only originally covered covers Domestic customers. The Non-Domestic TPI Working Group is no longer active. Made with representatives from TPIs, suppliers, consumer groups and other stakeholders.

Therefore Price Comparison Websites and Businesses are no longer legally required by Ofgem to provide Whole-of-Market and follow any Confidence Code.
Energy4 remains a comparison website. Committed to unbiased utility price discussions with all Clients depending on Credit Score and LOA.

    Court Cases
The most notable “court case” involving Octopus Energy for Business was a legal challenge by rival energy companies (including British Gas, E.ON, and ScottishPower) regarding Octopus Energy’s acquisition of the failed supplier Bulb Energy in 2022. The legal challenges were ultimately dismissed by the courts, which ruled that the acquisition process was fair and the government received fair value for Bulb.

The main court cases involving Octopus Energy relate to the government-backed acquisition of Bulb Energy, where rivals like British Gas, E.ON, and ScottishPower unsuccessfully challenged the sale on grounds of unfair state subsidy. These initial High Court and subsequent Court of Appeal challenges both failed, with judges finding the government’s process was open and competitive and that it received fair value. Separately, in July 2025, Octopus Energy was ordered to pay a £1.48 million fine to over 34,000 customers for failing to send final bills to prepayment meter customers on time.

    Bulb Energy acquisition case
The challenge: British Gas, E.ON, and ScottishPower brought judicial review proceedings against the UK government, arguing that the process of selling Bulb to Octopus was flawed and involved an unfair subsidy.

Initial High Court ruling: The High Court rejected the challenge, finding the sale process was open, non-discriminatory, and competitive, and that Octopus paid a fair price for the business.

Court of Appeal ruling: The companies appealed, but the Court of Appeal upheld the High Court’s decision, dismissing the appeal against the government’s subsidy-related decisions.
Reasoning: The court rejected the claims on grounds including “undue delay” in bringing the claims and that the merits of the subsidy control challenge also failed.

    Prepayment meter billing case
The issue: Ofgem found that Octopus Energy failed to send final bills to over 34,000 prepayment meter customers between 2014 and October 2023 in a timely manner.
The penalty: The regulator ordered Octopus to pay a total of £1.48 million in compensation and redress to the affected customers.
